Retail wine License

1. Legal basis:

- Decree No. 40/2008/ND-CP issued on April 07, 2008 of the Government on production and wine trading.

- Circular No. 10/2008/TT-BCT issued on July 25, 2008 of the Industry and Trade Ministry guiding the implementation of a number of articles of Decree No. 40/2008/ND-CP issued on April 7, 2008 on  production and wine trading.

2.Conditions to grant the retail business license, wine retail agent

2.1. Traders who have business registration about wine trading.

2.2. Having a fixed and clear address of business place

2.3. Wine business area is separate, which ensure the storage conditions on wine quality, preventing and fighting fire, food hygiene and safety, and environmental protection in accordance with the legal requirements.

2.4. There is written recommendation or retail contract, agent contract with at least one wine supplier (importers, productive facilities or wholesalers).

3. The procedure of certification for the wine retail license

3.1. Competent agencies: Department of Industry and Trade shall grant the wine retail license (or wine reseller license) for traders in the district area.

3.2. A dossier of application for a license consists of:

- An application form for a wine business license (Following the form in Appendix 6 or Appendix 9 attached to this Circular);

- Valid copies of business registration certificate;

- For the retail trader, there shall be need a written introduction or retail contract, reseller contract with at least one wine supplier;

4. A dossier of business place consist of: 

- Address and description of the wine business place;

- Documents prove the right of business location usage (as owner or co-owner or lease with a minimum period of 01 years);

- A list of equipments of testing and adjusting the temperature and humidity in the wine business area (to ensure that the business area is always cool, and avoid direct sunlight at alcohol products).

- Documents relating to the safety of prevention fire, food hygiene and safety, and environmental protection as prescribed by law.

- Execution time: 15 working days after receiving valid dossiers.

The period of validity of the wine business license is 05 years from the date of issue. Before 30 days from the date of the expiration of the license, traders must have a written to request renewal license and send to the competent state agency for industry and commerce which has granted licenses for traders.
