Registration of industrial designs protection

Industrial design is the appearance of the product expressed in shapes, lines, colors or combinations of these factors. To be protection, the invention/utility solution must satisfy the conditions: novelty, creativity, industrial applicability.

• Legal basis:

- Intellectual Property Law in 2005;

- Decree No. 103/2006/ND-CP;

- Circular 01/2007/TT-BKHCN;

- Circular No. 22/2009/TT-BTC .

• The agency has jurisdiction: Department of Intellectual Property

• Time: Within 09 to 12 months from the date of application.

• Intercode representatives to complete  the registration procedures for protection of industrial designs to customers, namely:

- After signing a service contract, Intercode will conduct designed profile registration of industrial designs to customers;

- Representatives in the National Office of Intellectual Property for filing registration  exclusively industrial designs to customers.

 - Representative track records and replies of the Intellectual Property Department; notification of the results submitted documents to customers;

- Representatives received the Certificate for industrial design at the Department of intellectual property for customers;

- Subscribe to the infringement of design, to draw up a profile litigation when necessary;

- Send the written reply  when disputes industrial design occur with the other applicant;

- Implementing the other relevant authorized.
